La Chambre n’a pas suivi le réquisitoire de l’Avocat général. Ce dernier avait demandé à ce que l’accusé soit condamné à 20 ans de réclusion criminelle. La Chambre a écarté la préméditation. S’agissant des intérêts civils, les parties civiles, en l’occurrence la mère et les deux sœurs du défunt, avaient réclamé 500 millions de francs. Mais la Chambre a revu cela à la baisse en leur allouant le montant de 75 millions de francs CFA (50 millions pour la mère et 25 millions de francs CFA aux deux sœurs). La chambre a débouté le regroupement des chauffeurs qui s’était constitué partie civile dans cette affaire.
Les faits imputés à Ousseynou Diop remontent le 27 octobre 2016. Ce jour-là, les deux hommes se sont rencontrés hasardeusement à la station Shell de Yoff pour remplir leur réservoir d’essence. Leurs deux véhicules se sont touchés. Mais, Ousseynou Diop qui était à bord de sa rutilante voiture de marque Mercedes n’a pas su digérer cela. Il descend de sa voiture pour aller se plaindre auprès du taximan Ibrahima Samb.
L’incompréhension s’installe entre les deux hommes. Ils s’échangent des propos aigres doux. Les nerfs s’échauffent. Le ton monte et les insultes volent en l’air. S’en est suivi une altercation soldée par la mort du conducteur de taxi. Devant le prétoire, l’accusé avait nié les charges. Il soutenait que la balle était sortie accidentellement de sa gâchette mais, il n’avait point l’intention de le tuer. Toutefois, sa version était contradictoire à celle donnée par les témoins, les pompistes de la station Shell. Ces derniers l’avaient tous chargé.
