Le Collectif des avocats de Karim Wade, informe l’opinion publique nationale et internationale que, depuis le 21 août 2020, le code électoral ne peut plus être invoqué par l’Etat du Sénégal pour faire obstacle à l’inscription de leur client sur les listes électorales et à sa candidature à toute élection.
Alors que la Cour de répression de l’enrichissement illicite (CREI), juridiction d’exception, n’était pas allée jusqu’à priver Karim Wade de ses droits civils et politiques, l’Etat du Sénégal a arbitrairement, sans aucune base légale, radié notre client des listes électorales en se prévalant de l’article L.31 du code électoral qui interdit l’inscription aux personnes condamnées.
Toutefois, l’article L32 du code électoral limite cette interdiction d’inscription sur les listes à une durée de 5 ans. Ainsi, depuis le 21 Août 2020, Karim Wade devient électeur et éligible en vertu de la loi électorale et par l’expiration du délai de 5 ans suivant la décision de la Cour suprême du 20 Août 2015 qui avait rejeté son pourvoi contre l’arrêt de condamnation par la CREI.
Le collectif rappelle que l’État du Sénégal a gravement et de manière persistante bafoué les droits de Karim Wade et refusé d’appliquer la décision du Comité des droits de l’homme des Nations Unies qui a jugé, en 2018, que l’arrêt de la CREI violait le Pacte international relatif aux droits civils et politiques et que l’État du Sénégal était tenu de faire réexaminer la condamnation de Karim Wade. Par ailleurs, le 31 octobre 2019, le Comité avait solennellement déclaré qu’il était «préoccupé par le fait que la décision du Conseil constitutionnel intervenue le 20 janvier 2019 (…) a invalidé la candidature de celui-ci au motif qu’il avait été condamné».
Le Collectif rappelle à l’État du Sénégal qu’il est tenu de se conformer strictement au respect de la Constitution et des traités internationaux qui garantissent les droits de Karim Wade, violés par les autorités de son pays depuis 2012.
Il lui demande de procéder sans délai à la réinscription de Karim Wade sur les listes électorales et réaffirme sa détermination à faire réviser son procès, comme l’exigent le Comité des droits de l’homme des Nations Unies ainsi que de nombreuses organisations qui agissent pour la défense des droits de l’homme et le respect des libertés et de la démocratie au Sénégal
