Le Président de la République a décidé, en pleine phase ascendante de l’épidémie, de laisser les activités économiques et professionnelles se dérouler en toute tranquillité en demandant aux sénégalais « d’apprendre à vivre avec le coronavirus ». Cette décision, synonyme de démission, aura de multiples conséquences notamment celle d’ériger les milieux de travail en potentiels foyers de contamination. En effet, la reprise des activités aura comme corollaire l’élévation du niveau de risque de contamination lors de l’accomplissement des activités économiques et professionnelles. Ce qui pose, avec acuité, la problématique de la prise en charge de la prévention de la covid-19 sur les lieux de travail.
Aucune mesure d’accompagnement n’a été prise par le Président de la République, détenteur de tous les pouvoirs en vertu de la loi d’habilitation, pour que des mesures de prévention spécifiques au monde au monde du travail soient prises en dehors de celles dites générales (se laver régulièrement les mains avec du savon et/ou une solution hydro-alcoolique, porter un masque, observer la distanciation sociale, etc.). Pire, la Caisse de sécurité sociale (CSS) brille par son immobilisme et son manque d’initiatives alors que l’une des missions ayant présidé à sa création est la prévention sur les lieux de travail. Elle n’est pas intégrée ou ne s’est pas intégrée (c’est selon), à tort, dans le dispositif global de lutte contre la covid-19. Ce qui dénote, du côté de ses responsables, un attentisme découlant d’une mauvaise lecture de la situation ou d’une mauvaise compréhension de leur mission et du côté gouvernemental, d’une absence de vision sur toutes les ressources sur lesquelles il peut compter pour lutter efficacement contre la covid-19.
Des mesures incomplètes et insuffisantes
Au début de la pandémie, l’OMS considérait faible le risque de contraction du virus si on ne revenait pas d’une région identifiée comme un foyer contaminé ou si on n’était pas en contact avec une personne affectée. C’est cela qui avait motivé les décisions telles que la fermeture des frontières et l’auto-confinement pendant 14 jours. Les données récentes ont permis de révéler un autre mode de contamination, qui ne cesse de prendre de l’ampleur : la transmission communautaire. Les personnes infectées par la covid-19, sans que l’on ne sache la source ni établir un quelconque lien épidémiologique, sont appelées des cas communautaires. Cela veut dire que le virus circule et se propage à l’intérieur d’une communauté. Les milieux de travail, étant par essence des communautés professionnelles, n’y échappent pas.
Si tous les travailleurs peuvent être exposés aux mêmes risques de la covid-19, des disparités pourraient apparaître selon leur statut juridique notamment en termes de prise en charge, d’indemnisation et de durée d’absence. Les fonctionnaires bénéficient d’un certain nombre de garanties qui leur assurent, entre autres, une prise en charge rapide, un maintien de l’intégralité de leur traitement durant leur absence au travail et pendant une certaine période, etc. Tel n’est pas le cas pour les travailleurs, qui ne sont pas des fonctionnaires, mais qui relèvent du Code du travail. Même s’ils sont des assurés sociaux au même titre que les fonctionnaires, leur assurance sociale est gérée par trois institutions de prévoyance sociale que sont l’IPRES (retraite et invalidité), la CSS (accidents du travail, maladie professionnelle, etc.) et les IPM (maladie non professionnelle).
Lorsqu’un travailleur, qui n’est pas fonctionnaire, est contaminé par la covid-19 dans l’exercice de ses activités professionnelles, le lien de cause à effet (exposition professionnelle – contamination à la covid-19) ne suffirait pas à lui seul pour que sa contamination soit considérée comme une maladie professionnelle. Pour que celle-ci soit considérée comme maladie professionnelle et, subséquemment, donne droit à une prise en charge et à une indemnisation, il faudrait que la covid-19 soit inscrite sur les tableaux des maladies professionnelles prévus à l’article 34 du Code de sécurité sociale et pris par un arrêté interministériel (ministères en charge du Travail et de la Santé). À la date d’aujourd’hui, la covid-19 ne fait pas partie des tableaux des maladies professionnelles. Ce qui signifie qu’un travailleur contaminé par le fait et à l’occasion de son travail par la covid-19 se verrait refuser toute prise en charge et toute indemnisation par la CSS.
C’est là où le Gouvernement a manqué de vision, car dans plusieurs autres pays notamment en France (que Sénégal recopie systématiquement), des dispositions dérogatoires sont prises, d’une part, pour reconnaître la covid-19 comme maladie professionnelle et, d’autre part, pour alléger les procédures de déclaration pour qu’un travailleur atteint puisse commencer, très rapidement, à recevoir ses indemnités de remplacement de revenus. La loi d’habilitation conférant au Président de la République de légiférer par voie d’ordonnances devrait servir à cela, entre autres. Les ministères en charge du Travail et de la Santé devaient jouer leur partition en modifiant l’arrêté interministériel par l’inscription de la covid-19 dans les tableaux des maladies professionnelles.
Ce serait une méprise, une injustice, voire une grave erreur d’assurer la prise en charge et l’indemnisation des travailleurs relevant du Code du travail contaminés par la covid-19 au moyen des deniers publics à travers le Fonds Force covid-19 mis en place par le Gouvernement. En effet, ces travailleurs sont assurés par la CSS, qui reçoit les primes payées par les employeurs en contrepartie notamment d’une prise en charge et d’un versement de prestations en espèces et/ou en nature survenant une maladie professionnelle ou un accident du travail. C’est le minimum qu’on puisse exiger de cette institution en prenant le soin, au préalable, de modifier certaines dispositions légales et règlementaires de façon dérogatoire. Avec un peu de courage et plus d’initiatives, le Gouvernement aurait pu compléter son offre de remises fiscales, d’un montant de 200 milliards, par un différé sur les cotisations sociales, lesquelles peuvent être importantes pour les PME dont les salaires ne sont élevés.
L’inertie de la Caisse de sécurité sociale
Aujourd’hui, dans tous les pays organisés, les organismes de sécurité sociale comme la CSS sont en première ligne pour lutter contre la covid-19. Ils sont même inclus sur la liste des services essentiels, car ils ont une mission préventive, laquelle doit les conduire à soutenir les entreprises de manière que leurs activités puissent reprendre ou continuer dans des conditions saines et sécuritaires grâce à la mise en œuvre des mesures visant à identifier, corriger et contrôler les situations de travail associées au risque de la covid-19.
Pour faire simple, encore, nous pouvons prendre l’exemple français où les Caisses régionales d’assurance maladie (CRAM) devenues caisses d’assurance retraite et de la santé au travail (CARSAT) sont en première ligne dans la lutte contre la covid-19. En plus de se montrer diligentes dans la mise en œuvre des mesures dérogatoires prises par l’État par ordonnances et voie règlementaire (décrets et arrêtés) au profit des travailleurs infectés par le coronavirus, elles se montrent actives au plan de la prévention. Ce qui a amené plusieurs d’entre elles à développer rapidement des outils (guides, check-list, etc.) et des capsules d’information et de sensibilisation à destination des entreprises. Certaines y associent même l’octroi d’une subvention financière permettant aux PME, par exemple, de pouvoir acquérir des équipements de protection, de mettre en place des mesures de distanciation physique ou d’hygiène et de réaliser des nettoyages.
Ici, la CSS brille par son mutisme et son manque de réactivité alors que c’est en ce moment précis que le monde du travail a besoin de ses services. Un simple détour sur le site internet de la CSS permet de se faire une idée sur l’immobilisme de cette importante institution, qui collecte des milliards de francs CFA de cotisations auprès des employeurs et qui leur est inutile au moment ils ont beaucoup plus besoin d’elle en termes de conseils, d’accompagnement dans les mesures de prévention à mettre en place, etc. Le besoin est là et criard. Un petit exemple suffit pour se rendre compte de la portée de ce constat : Dakar Dem Dik devra assurer le service de transport public. Ses agents, surtout ceux affectés à l’exploitation de son réseau, vont être en contact avec des milliers de passagers quotidiennement et se relayer aux mêmes postes de travail (cabines de conduite et guichets). C’est là où la CSS pourrait montrer toute son utilité notamment en préconisant des mesures de prévention supplémentaires visant à rompre toute chaîne de transmission possible. Dans le cas des transports collectifs, la CSS pourrait recommander, sur la base des connaissances scientifiquement établies, des mesures comme celles de nettoyer les bus à chaque rotation (volant, poignées, tableau de bord, clés, et l’habitacle servant de guichet) à l’aide de produits désinfectants adaptés, l’utilisation de guides ou check-list permettant de faire une évaluation sommaire des situations de travail, le visionnement de capsules d’information et de sensibilisation, etc.
Au total, si le tir n’est pas rectifié grâce à une approche proactive et préventive de la CSS à l’endroit des lieux de travail, nous risquons de nous ramasser, dans les prochaines semaines avec plusieurs cas de travailleurs contaminés, alors que nous pouvons l’éviter par la mise en place de mesures préventives adéquates. Cela demande de la vision et de l’audace et surtout de la fermeté de la part du Gouvernement en exigeant que la CSS assume et joue pleinement son rôle, particulièrement en ces périodes.
