C’est cela qui avait motivé les décisions telles que la fermeture des frontières et l’auto-confinement pendant 14 jours. Les données récentes ont permis de révéler un autre mode de contamination, qui ne cesse de prendre de l’ampleur : la transmission communautaire. Les personnes infectées par la covid-19, sans que l’on ne sache la source ni établir un quelconque lien épidémiologique, sont appelées des cas communautaires. Les fonctionnaires bénéficient d’un certain nombre de garanties qui leur assurent, entre autres, une prise en charge rapide, un maintien de l’intégralité de leur traitement durant leur absence au travail et pendant une certaine période, etc. Tel n’est pas le cas pour les travailleurs, qui ne sont pas des fonctionnaires, mais qui relèvent du Code du travail. Même s’ils sont des assurés sociaux au même titre que les fonctionnaires, leur assurance sociale est gérée par trois institutions de prévoyance sociale que sont l’IPRES (retraite et invalidité), la CSS (accidents du travail, maladie professionnelle, etc.) et les IPM (maladie non professionnelle).
Lorsqu’un travailleur, qui n’est pas fonctionnaire, est contaminé par la covid-19 dans l’exercice de ses activités professionnelles, le lien de cause à effet (exposition professionnelle – contamination à la covid-19) ne suffirait pas à lui seul pour que sa contamination soit considérée comme une maladie professionnelle. Pour que celle-ci soit considérée comme maladie professionnelle et, subséquemment, donne droit à une prise en charge et à une indemnisation, il faudrait que la covid-19 soit inscrite sur les tableaux des maladies professionnelles prévus à l’article 34 du Code de sécurité sociale et pris par un arrêté interministériel (ministères en charge du Travail et de la Santé). À la date d’aujourd’hui, la covid-19 ne fait pas partie des tableaux des maladies professionnelles. Ce qui signifie qu’un travailleur contaminé par le fait et à l’occasion de son travail par la covid-19 se verrait refuser toute prise en charge et toute indemnisation par la CSS.
C’est là où le Gouvernement a manqué de vision, car dans plusieurs autres pays notamment en France (que Sénégal recopie systématiquement), des dispositions dérogatoires sont prises, d’une part, pour reconnaître la covid-19 comme maladie professionnelle et, d’autre part, pour alléger les procédures de déclaration pour qu’un travailleur atteint puisse commencer, très rapidement, à recevoir ses indemnités de remplacement de revenus. La loi d’habilitation conférant au Président de la République de légiférer par voie d’ordonnances devrait servir à cela, entre autres. Les ministères en charge du Travail et de la Santé devaient jouer leur partition en modifiant l’arrêté interministériel par l’inscription de la covid-19 dans les tableaux des maladies professionnelles.
Ce serait une méprise, une injustice, voire une grave erreur d’assurer la prise en charge et l’indemnisation des travailleurs relevant du Code du travail contaminés par la covid-19 au moyen des deniers publics à travers le Fonds Force covid-19 mis en place par le Gouvernement. En effet, ces travailleurs sont assurés par la CSS, qui reçoit les primes payées par les employeurs en contrepartie notamment d’une prise en charge et d’un versement de prestations en espèces et/ou en nature survenant une maladie professionnelle ou un accident du travail. C’est le minimum qu’on puisse exiger de cette institution en prenant le soin, au préalable, de modifier certaines dispositions légales et règlementaires de façon dérogatoire. Avec un peu de courage et plus d’initiatives, le Gouvernement aurait pu compléter son offre de remises fiscales, d’un montant de 200 milliards, par un différé sur les cotisations sociales, lesquelles peuvent être importantes pour les PME dont les salaires ne sont élevés.
L’inertie de la Caisse de sécurité sociale
Aujourd’hui, dans tous les pays organisés, les organismes de sécurité sociale comme la CSS sont en première ligne pour lutter contre la covid-19. Ils sont même inclus sur la liste des services essentiels, car ils ont une mission préventive, laquelle doit les conduire à soutenir les entreprises de manière que leurs activités puissent reprendre ou continuer dans des conditions saines et sécuritaires grâce à la mise en œuvre des mesures visant à identifier, corriger et contrôler les situations de travail associées au risque de la covid-19.
