La direction générale des Impôts et domaines vient de mettre en vente les appartements dakarois du complexe Eden Roc de Bibo Bourgi. Ses avocats affirment cependant que ces immeubles auraient été confisqués ‹‹ illégalement ››, s’appuyant sur une sentence arbitrale rendue fin 2019 par une commission de l’ONU et jusque-là tenue secrète.
L’arrêt rendu par la Cour de répression de l’enrichissement illicite (CREI) en mars 2015 a-t-il mené à la confiscation « illicite » des biens appartenant à Ibrahim Aboukhalil, alias Bibo Bourgi ? C’est ce qu’a affirmé dans un communiqué son avocate Corinne Dreyfus-Schmidt, ce 20 juillet, à la veille de la mise en vente des appartements Eden Roc, situés dans le centre-ville de Dakar.
Bibo Bourgi avait été condamné par la CREI en 2015 pour complicité d’enrichissement illicite aux côtés de Karim Wade Confisqués à son propriétaire par l’État du Sénégal, ces appartements viennent d’être mis en vente par la Direction générale des impôts et domaines.
Leur confiscation a toutefois été jugée illégale, selon un règlement d’arbitrage de la commission des Nations unies pour le droit commercial international (CNUDCI) rendu le 24 octobre 2019. Selon nos informations, la décision évoque un déni de justice et condamne l’État du Sénégal à de lourds dommages et intérêts en raison du préjudice subi par Bourgi. (Source J.A)
