Législatives 2022: « Yewwi Askan Wi S’Arc-boutent Sur Un Argument Juridique Bidon » (Amadou Aly Mbaye Juriste)

La trouvaille de la coalition Yewi semble trop légère pour contrebalancer leur bourde sur la violation de la loi sur la parité lors de leur investiture. Certains leaders de cette coalition ( les autres ne sont pas concaincus) s’arc-boutent sur un argument juridique bidon, qui n’a d’égal que leur désespoir face à l’irrecevabilité de leur liste dans le département de Dakar.

En effet, la décision N 2-E-2019 du 13 Janvier 2019 qu’ils appellent jurisprudence Malick Gackou aurait également pu s’appeler Jurisprudence Macky Sall, Idrissa Seck, Ousmane Sonko etc.
Aux considérants 13, 17 et 21, de ladite décision, après vérification, les trois candidats ont respectivement présenté une liste de parrainage validée de 62 689, de 57 276 et de 61 791 électeurs, dépassant pourtant largement les minima requis.
Si malgré ce dépassement, les candidatures des trois candidats ont été recevables c’est par ce qu’au 4ème considérant de la même décision, les 7 sages ont clairement signifié, en substance que « …… le nombre de parrainages validés doit être, au moins (qui a tout son sens),égal aux minima requis, soir 53 457 électeurs inscrits au fichier électoral…….. »

Si, comme ils le soutiennent, le rejet de la candidature de Gackou a pour seul motif le surplus de parrains, le conseil constitutionnel aurait rejeté les candidatures de ces trois candidats pour le même motif.
Alors, il est très clair que les élucubrations de l’opposition sur une éventuelle invalidation de la liste de la coalition BBY a pour seul objectif la surenchère.

D’ailleurs, le silence de la société civile et le mépris des autres membres de la coalition Yewi sur cet argument désespéré est révélateur de son impertinence.
Une erreur, on l’assume. Et en politique, elle se paye cash.
Une élection se gagne sur le terrain.
