DECLARATION
SUR LA CRISE SENELEC – AKILEE
Le contrat liant SENELEC à la société AKILEE est l’objet de fortes critiques et remises en cause. Des précisions sur son contenu ont été données par la presse et la société AKILEE.
Le Congrès de la Renaissance Démocratique (CRD) tient à faire connaître sa position sur ce dossier. Elle est la suivante.
1. L’actionnariat connu de la société AKILEE regroupe des personnes qui ont été en charge de la conception du plan stratégique de la SENELEC. Dans le cadre de cette prestation de service, elles ont été en mesure de connaître des difficultés de la SENELEC, de proposer des plans de sortie desdites difficultés, et de développer des relations particulières et privilégiées avec le personnel dirigeant de la SENELEC. Le plan stratégique élaboré par ces consultants, intitulé « Yeessal » et couvrant la période 2016-2020 recommande notamment le « développement de compteurs communicants/intelligents, rendant les réseaux plus intelligents ».
2. Les consultants externes ont également été au fait de diverses propositions faites par des fournisseurs tels HEXING et HUAWEI.
3. Ces offres, qui sont assimilables à celle proposée puis mise en œuvre par AKILEE, présentaient l’avantage de rendre la SENELEC propriétaire de la plateforme de gestion des compteurs intelligents après acquisition d’un nombre minimum par elle (350 000 compteurs pour la proposition HEXING, et 400 000 pour la proposition HUAWEI). AKILEE a donc eu le loisir d’en avoir connaissance dans leurs principes et dans leur contenu.
Le CRD retient donc le contrat liant la SENELEC et AKILEE comme corrompu par un grave délit d’initié.
4. Présentée par le Directeur général de l’époque comme une filiale de la SENELEC pour justifier en partie le contournement des dispositions relatives à la passation de marchés, AKILEE n’en est pas une au sens strict des dispositions de l’OHADA car la SENELEC n’en détient que 34% du capital et non 51% au moins
5. Le contrat prévoit la vente à la SENELEC de matériels (principalement des compteurs) et la fourniture de prestations. Il a été conclu de gré à gré et n’a pourtant pas fait l’objet d’un appel ouvert à la concurrence, ne respectant donc pas la législation et la réglementation relatives à l’attribution des marchés.
Le CRD retient donc le contrat liant la SENELEC et AKILEE comme ayant violé la législation et la réglementation sénégalaises en matière d’attribution de marchés de fournitures et de prestations, et demande que la responsabilité des dirigeants de la SENELEC impliqués dans la signature du contrat soit engagée, également celle des dirigeants de AKILEE.
L’important « décalage » existant entre les offres HEXING et HUAWEI d’une part et AKILEE d’autre part sont assimilables à de l’escroquerie pure et simple dont fait l’objet une société nationale.
6. Le contrat crée une distinction entre la propriété des compteurs (payés et propriété de la SENELEC) et celle de la plateforme permettant leur gestion (demeurant propriété de AKILEE). Cet aspect léonin du contrat met la SENELEC dans une situation de dépendance à long terme à l’égard de AKILEE. La pratique habituelle en la matière consiste à rendre la société d’électricité propriétaire de la plateforme de gestion des compteurs après qu’elle a acquis un nombre minimum de compteurs.
7. La durée du contrat (10 ans) crée une rente inadmissible au profit de AKILEE, mise à la charge des consommateurs ou de la SENELEC.
8. La distinction entre la propriété des compteurs et la plateforme de leur gestion empêche la SENELEC de changer de fournisseur et de prestataire au terme des 10 années de contrat sauf à devoir changer tous ses compteurs et à acquérir une autre plateforme. Ces coûts au terme du contrat remettent en cause l’intérêt du contrat pour la SENELEC, et l’essentiel des gains présentés comme certains pour elle et justifiant la signature du contrat. Cet aspect du contrat ne permet pas un recours à la concurrence y compris au terme des 10 ans de contrat.
9. Les conditions de rupture du contrat sont également totalement déséquilibrées en faveur de AKILEE
Le CRD considère ces aspects du contrat léonins et inadmissibles. Ils confirment les conditions anormales rappelées ci-dessus de la signature du contrat portant délit d’initié et violation de la réglementation en matière de passation de marchés. Il appartient à l’État du Sénégal d’engager des poursuites pénales contre les dirigeants de SENELEC et ceux de AKILEE impliqués dans cette forfaiture, et à la justice sénégalaise d’identifier des délits de concussion et d’escroquerie manifestes.
Conclusion portant sur le sort du contrat :
Le CRD demande l’arrêt immédiat de l’exécution du contrat SENELEC-AKILEE sans crainte des conséquences possibles du contentieux qui pourrait en naître. En effet le coût éventuel de cette rupture ne saurait atteindre le niveau des lourdes pertes que la SENELEC devra subir du fait de la rente que le contrat crée au bénéfice d’AKILEE et des charges de renouvellement des compteurs et de la plateforme que l’arrêt du contrat impliquera au terme des dix années de sa durée.
Le CRD demande que la SENELEC engage toutes les actions judiciaires que nécessitent les graves violations de la loi et de la réglementation sénégalaises constatées. Il demande à l’État du Sénégal de faire diligenter les enquêtes et contrôles idoines par tous les corps et organes que les faits concernent.
Le CRD regrette ce nième scandale financier innommable, portant sur des centaines de milliards de francs CFA. Il s’ajoute à la longue série de ceux l’ayant précédé, laquelle apparaît désormais comme constitutive de l’ADN du régime de Macky SALL.
