La liberté d’information est consacrée par de nombreux instruments juridiques internationaux, dont le Pacte international relatif aux droits civils et politiques (1966), la Convention américaine relative aux droits de l’homme (1969), la Résolution 59 de l’Assemblée générale des Nations Unies adoptée en 1946, et l’Article 19 de la Déclaration universelle des droits de l’homme (1948). Le droit à l’information figure en bonne place dans notre charte suprême (cf article 8).
Dans la nuit du 03 au 04 juin 2020, de violentes émeutes ont éclaté dans plusieurs régions du Sénégal. Ce sont des faits. En matière de journalisme, les faits sont les faits. Ce qui s’est passé dans la nuit du 03 au 04 juin 2020, est une révolte spontanée et citoyenne. Le groupe D-média n’a ni provoqué ces actes, ni cautionné ces actes. Il s’est contenté de les commenter et de les porter à la connaissance de l’opinion publique. Ni plus, ni moins.
Dans un courrier adressé à la Direction de Dmedia, le CNRA laisse entendre qu’en diffusant les informations relatives à ces émeutes, ce groupe aurait ‘’incité les jeunes à la violence’’.
Primo, il s’agit d’une accusation fallacieuse, gratuite et mensongère d’une extrême gravité du CNRA qui ne repose sur aucun élément étayé. Aucun citoyen sénégalais ayant participé à ces émeutes n’a affirmé qu’il a été incité à la violence par D-MEDIA, permettant au CNRA d’aboutir à une telle conclusion loufoque. Comment un organe comme le CNRA peut-il tomber de tels travers (accusations gratuites sans aucune preuve) ?
Secundo, il n’appartient pas au CNRA de se muer en un organe de censure au service de l’exécutif. Alors que les faits se sont déroulés, dans la nuit 03 au 04 juin, il est surprenant que dans la journée du 04 juin, le collège du CNRA se soit réuni très rapidement pour délibérer sur le sujet et produire un communiqué. Le CNRA comprenant neuf membres nommés par Macky Sall, il serait intéressant de savoir si le quorum était atteint au moment de la délibération (moitié des membres présents), conformément à l’article 19 de la loi 2006-04 du 04 janvier 2006 portant création du CNRA. S’agirait d’une réunion expresse, sur ordre de Macky Sall ?
Les dérapages fréquents du CNRA interpellent et heurtent désormais tous les démocrates et citoyens sénégalais. Le CNRA n’est pas BIG BROTHER. Au demeurant, l’indignation de cet organe est politique, sélective et hautement suspecte, car elle vise spécifiquement un groupe de presse : D-MEDIA. La mission du CNRA n’est pas d’empêcher les journalistes d’aller sur tous les terrains, pour enquêter, couvrir les faits et informer le public.
Si 4 policiers ont été démis de leur fonction après plusieurs nuits d’émeutes aux Etats Unis, c’est parce que la diffusion de la vidéo de l’interpellation meurtrière de Georges Floyd a permis d’établir les faits et de confondre les policiers fautifs. Personne n’a dit que l’auteur de la vidéo est à l’origine des violences aux Etats-Unis. En France, les médias ont relayé et diffusé les manifestations violentes des gilets jaunes qui ont saccagé les champs Élysées. Récemment, tout le monde a vu les scènes de violences de jeunes déchaînés, semant le chaos et brûlant tout sur leur passage à Paris pour dénoncer les violences policières (mort d’Adama Traoré). Personne n’a conclu que les médias sont à l’origine de ces violences.
Le CNRA doit arrêter de raconter des sornettes auxquelles personne ne croit. Il n’y a aucune preuve d’incitation à la violence et le groupe D-Média pourrait même porter plainte contre le CNRA qui ne dispose d’aucun élément pour étayer ses dires. Cette tentative d’intimation du CNRA (bras armé du régime) est ridicule et fera pschitt.
STOP, ça suffit : la liberté d’informer est consubstantielle à la démocratie.
