Covid-19 : Pass Sanitaire Et Vaccination Obligatoire Des soignants Validés En France

La loi instaurant le pass sanitaire et la vaccination obligatoire des soignants a été validée jeudi par le Conseil constitutionnel, qui a en revanche censuré les dispositions relatives à l’isolement obligatoire des personnes diagnostiquées positives au Covid-19.

Le législateur a poursuivi l’objectif de valeur constitutionnelle de protection de la santé« , notent les Sages à propos du pass et de la vaccination des soignants.

Les juges constitutionnels français ont toutefois estimé que l’isolement obligatoire des malades de 10 jours n’était ni « nécessaire, adapté et proportionné » en ce qu’il constitue une mesure privative de liberté « sans décision individuelle fondée sur une appréciation de l’autorité administrative ou judiciaire ».
