Le commerçant, A. Seck a fait face hier au tribunal de grande instance de Pikine- Guediawaye pour « abus de confiance » portant sur un montant de 15 millions 630 mille de francs CFA au préjudice de son neveu, M. Ndour. Pour ce motif, le prévenu est condamné à 6 mois dont 3 ferme.
Les sentiments n’ont pas leur place dans le business. A. Seck l’a appris à ses dépens. Il avait reçu de son neveu, M. Ndour 500 cartons d’huile d’essences d’une valeur de 15 millions de francs 630 mille francs. Un montant qu’il devait restituer après vente. Après 3 ans, il ne s’est pas acquitté de sa dette. Menacé par ses partenaires d’Europe de le traduire en justice, il n’a pas laissé de choix à son neveu M. Ndour. Ce dernier, après plusieurs mises en demeures a tout simplement déposé une plainte contre son oncle, A. Seck pour abus de confiance.
Comparaissant hier au Tribunal de Grande instance de Pikine-Guédiawaye, le mis en cause, A. Seck m qui se déplaçait à l’aide des béquilles a reconnu les faits sans ambages. Il avoue avoir reçu 500 cartons d’huiles d’essences d’une valeur de 15 millions. Mais s’il n’a pas respecté ses engagements, c’est parce qu’il avait utilisé cet argent pour passer une commande des marchandises au Gabon et payer avec le reste ses créances. Pour justifier son acte, il prétend aussi être malade.
La partie civile, M. Ndour dit être revenu au bercail après 26 ans d’immigration, pour investir. Et après une relation de confiance établie avec son oncle, il a confié à ce dernier 521 cartons d’huiles d’essences. Mais quelques temps après A. Seck lui avait demandé l’autorisation de les vendre afin de pouvoir en tirer profit. Ce qu’il a accepté. Mais, mal lui en a pris. Car 3 ans après, il court encore derrière son dû. Las d’attendre, M. Ndour a porté plainte à contre cœur contre son oncle. « J’avais de l’estime pour mon oncle car je le porte dans mon cœur. Les faits ont duré plus de 3 ans. Je ne demande que mes 15 millions 360 mile francs », a soutenu la partie civile. En tout cas, il y’a un début de solution avec un acompte de 2 millions remis au plaignant par l’avocat de la défense. Malheureusement, celui-ci a refusé de le prendre sous prétexte que c’est une modique somme. Il réclame ses 15 millions 360 mille en guise de réparation du préjudice.
Selon le conseil de la défense, son client est malade, même s’il reconnaît la constance des faits. «Il est dans un état de santé dégradée. Ils ont eu de bons rapports. Mon client est de bonne foi. Je sollicite une application extrêmement bienveillante de la loi. Il a plus de 60 ans. Si vous lui tendez la perche, il fera tout pour rembourser l’intégralité de cette somme », a plaidé la robe noire. De son côté, le ministère public a requis l’application de la loi. Finalement, A. Seck a été déclaré coupable et condamné à 6 mois dont 3 mois ferme. En sus, Il devra payer 15 millions 630 mille francs à M. Ndour pour la réparation du préjudice.
