Procés du parti socialiste : Le tribunal des référés declare nulle la procédure pour irrégularité

Le juge des référés du Tribunal de Grande instance de Dakar a finalement a re du hier  son verdict dans le différend opposant la direction du Parti socialiste (PS) à une faction dissidente de la formation politique. En effet, dans sa décision, il a déclaré «nulle la procédure pour irrégularité de fond».

Au préalable, le Tribunal a rejeté l’exception d’incompétence, comme étant «mal-fondée». Pour ce qui est de la fin de non-recevoir tirée de l’absence de personnalité morale, le Tribunal a déclaré qu’«elle s’analyse plutôt en une cause de nullité pour irrégularité de fond».

Pour rappel, la requête est à l’initiative d’un collectif de cadres du Parti socialiste (PS) et vise Aminata Mbengue Ndiaye, secrétaire générale intérimaire du PS. L’assignation vise à mettre fin à sa suppléance et à rétablir la légalité au sein du parti.

Les demandeurs soutiennent que depuis le décès d’Ousmane Tanor Dieng en 2019, aucun congrès n’a été organisé et que les instances du PS sont à l’arrêt. Évoquant par ailleurs l’état de santé d’Aminata Mbengue Ndiaye, ils exigent la convocation d’un congrès pour élire un nouveau secrétaire général.

La défense d’Aminata Mbengue Ndiaye avait rejeté les arguments de la partie adverse, rappelant qu’un congrès est déjà prévu pour décembre 2025.
