La partie civile, Ab. Diop est dans de beaux draps. Pour aider son ami M. Diop, il a remis à celui-ci les papiers de sa maison en gage à la banque pour un prêt de 250 millions durant 30 ans. Estimant qu’il a été grugé, il a traîné en justice M. Diop et M. Dieng pour escroquerie.

Revenant sur sa mésaventure, La partie civile explique qu’il est un fonctionnaire de la hiérarchie A au ministère des finances et du budget. Un jour, M. Diop, un de ses amis lui réclamait de l’argent. Selon lui, disait qu’il a une ligne de crédit entre Sococim et Bimao. Pour le recevoir, il lui a réclamé son titre foncier de maison R+5 qui se situe à la cité ‘‘Gorgui’’. En premier lieu, le plaignant avait refusé. Mais par la suite, il a fini par accepter. Pour plus d’assurance, ils se sont rendus dans le cabinet du notaire, Me Aliou Ka. Toutefois, sur le papier qu’il a signé, c’est le nom de M. Dieng qui y apparaisse. « M. Diop m’avait promis qu’il allait louer ma maison à 12 millions annuellement. Après la remise de la première année, il ne versait plus normalement. Par la suite, je l’ai perdu de vue de même que son ami M. Dieng. J’ai donné ma maison en gage pour un an et non pour 30 ans. Durant la première année, ils ont pris 330 millions FCFA en ciment » a conté la partie civile devant le parloir des flagrants délits. Il avoue qu’il ne savait que l’acte qu’il a signé, faisait état de 30 ans.
Traduit en justice pour escroquerie, M. Diop confirme que la partie civile est son ami. Mais, il précise qu’il l’avait mis en rapport avec M. Dieng. « Ce dernier est un vendeur de ciment et de fer. Ils se sont associés par la suite », s’est-il dédouané. Son acolyte, M. Dieng qui est poursuivi pour les mêmes faits dira que la banque lui a accordé un prêt de 250 millions. « j’ai donné en gage le titre foncier de la partie civile. Il me l’a accordé sans contrainte. On s’est rendu ensuite chez son notaire, Me Aliou Ka pour signer l’acte », dit-il.
L’avocat de la partie civile, Me Ameth Fall a réclamé 300 millions en guise de dédommagement. Pour le parquet, le plaignant a remis son titre foncier sur le fondement de la confiance. « Au moment de la signature du protocole, il a constaté le nom de M. Dieng. Mais il est revenu à de meilleurs sentiments suite aux assurances de M. Diop. Les actes notariés valent jusqu’à inscription de faux », a observé parquetier qui requiert la relaxe pour les prévenus. La défense a suivi le réquisitoire du parquet. Au Finish, M. Diop et M. Dieng ont été relaxés purement et simplement.
