Hier, il comparaissait devant le tribunal de Grande Instance de Pikine-Guediawaye pour escroquerie et de conclusion de convention portant sur une domaine nationale, le prévenu risque 4 ans de prison ferme. I. B Wellé sera fixé sur son sort le 15 avril prochain.
Promoteur immobilier de son état, I. B Wellé s’est mué en vendeur de terrains. Ce prédateur foncier établi à Keur Massar sise Jaxaay 1, avait vendu des terrains à usage d’habitation à O. SECK, A. GUEYE, Henriette A. DIATTA, C. BARRY et M. NDIAYE. Mais après avoir encaissé les sommes, il n’est pas en mesure de leur remettre les papiers administratifs afférents à ces parcelles. Ce qui a fait que les démarches entreprises par ces derniers sont restées vaines. Après plusieurs sommations, ils ont finalement porter plainte contre lui.
Interrogé, I. B WELLE n’a pas eu de la peine à reconnaître les faits qui lui sont reprochés. Il a même pris des engagements pour rembourser l’intégralité des dues à leur propriétaire dans un délais raisonnable. Pour ce faits constitutifs d’escroquerie foncière, il a été traduit devant le tribunal des flagrants délits de Pikine-Guédiawaye par 10 parties civiles.
Le prévenu avoue son tort
Le gérant de l’agence immobilière « Sope Naby » déclare avoir créé sa société en 2017. Et grâce à elle, il a vendu des terrains usage d’habitation à O. SECK, Sokhna Mariama DIOP, A. GUEYE, H A. DIATTA, C. BARRY et M. NDIAYE. Mais quelques temps après, l’Etat a exproprié ces parcelles au profit de E. WARDINI. » Mais comme j’avais encaissé des sommes dues à la vente de ces terrains, des problèmes ont survenu et les clients ont commencé à se ruer vers moi. C’est ainsi que je me suis absenté pendant quelques années avant que je sois appréhendé et déféré au parquet le 25 Février 2022. Mais, j’ai été extrait de prison pour mon audition par rapport à d’autres plaignants », a expliqué le prévenu.
Le parquis requiert 4 ans de prison ferme
Dans ses observations, le substitut du procureur précise que les terrains vendus par le prévenu sont du domaine nationale. « le délit de conclusion d’une convention portant sur une domaine nationale ne souffre d’aucune contestation. Ce délit est intentionnel. Selon lui, le mis en cause savait qu’il était dans une terre nationale. Mais il prétend avoir vu le maire pour avoir des terrains. « Il est un agent immobilier donc il n’est pas novice. Pour la remise, cela date de 2003 jusqu’à 2021. I.B Wellé se dit être propriétaire de plusieurs terrains pour se faire remettre des sous. Alors que les terres ne lui appartiennent même Pas. Il ne détenait qu’une délibération qui ne prouve rien. Il a vendu des parcelles à keur massar, à Kounou, Ndiague, lac Rose et autres. Il ne produira jamais ni un titre, ni une délibération valable. On ne peut pas reprocher aux plaignants de ne pas aller aux cadastres pour vérifier le terrain. Ils ne peuvent pas le savoir. Ce sont des faits d’une particulière gravité. Il trouble l’ordre public. Ces faits sont particulièrement graves. Il a été condamné en 2019 dans ce tribunal de même à Dakar. On ne doit pas lui donner l’occasion de faire d’autre victime », a souligné le parquetier qui a requis 4 ans de prison ferme et une amende d’un million de Francs Cfa. La dépense plaide la relaxe. Délibéré au 15 avril prochain.
