Les députés sont convoqués ce lundi en plénière pour examiner le projet de loi modifiant la loi N° 69 du 29 avril 1969 relative à l’état d’urgence et à l’état de siège. Le nouveau texte insère un troisième régime, la gestion des catastrophes naturelles et sanitaires. Et une fois adopté, le président de la République pourra légiférer en roue libre, décrétant l’état d’urgence assorti d’un couvre-feu, restreignant les déplacements sans passer par l’Assemblée nationale. Et l’avis de l’avocat Doudou Ndoye, de Pape Demba Sy, agrégé des facultés de droit et l’opposition font foi.
Après son passage en commission vendredi dernier, les députés sont convoqués, ce lundi en séance plénière pour statuer sur ledit projet de loi.
Pour Me Doudou Ndoye trouve opportune la modification de la loi, pour permettre au chef de l’Etat de prendre des décisions d’urgence que requiert une situation de catastrophe sanitaire ou naturelle. La mesure exceptionnelle est une mesure législative réglementaire. Parce que, dit-i-il, gouverner c’est prévoir.
In fine, conclut-il, le chef de l’Etat titulaire du pouvoir exécutif, se voit investi par le Parlement de pouvoirs exceptionnels prévus par une loi exceptionnelle pour veiller à la santé des populations.
Maintenant comment le pouvoir législatif applique-t-il ces mesures là ? Les applique-il bien ou mal ?, s’interroge la robe noire.
Pour Pape Demba Sy, agrégé des facultés de droit, devant la situation dévastatrice du covid-19, l’Etat qui s’occupe de la sécurité des populations et de leur Bien Etre, doit être en mesure de prendre les décisions qu’il faut. Mais, tout en faisant que les libertés soient respectées. Ces situations doivent être encadrées. Car, poursuit-il, si on est dans un état de droit, on doit respecter les libertés, mais c’est le juge en dernière instance qui doit se prononcer.
Techniquement, ajoute le professeur, on aurait pu adopter un autre texte, une loi différente qui concerne le cadre de calamité naturelle et sanitaire d’une manière générale.
Concernant l’opposition, ces mesures sont attentatoires aux libertés, On remet en cause tous les principes de base du droit pénal. Le vice-président de la commission des lois, Cheikh Abdou Mbacké Bara Dolli, compte attaquer le projet de loi devant le conseil constitutionnel. Il a 11/17 signatures des députés…
