Le Bénin, le Sénégal et le Ghana ne feront désormais plus partie de la liste des pays d’immigration dits « sûrs » de l’Office français de protection des réfugiés et apatrides.
Dans une décision motivée principalement par la protection des personnes LGBT et la volonté d’offrir à leurs ressortissants l’espoir d’une procédure d’asile plus clémente en France, le Conseil d’État a retiré, vendredi 2 juillet, les Républiques du Bénin, du Sénégal et du Ghana de la liste française des pays dits « sûrs ».
Cette liste de 16 pays établie par l’Ofpra (Office français de protection des réfugiés et apatrides) fait l’objet d’une bataille judiciaire qui a débuté à la fin de 2019, après l’entrée en vigueur de la loi asile et immigration, qui expose les ressortissants de ces pays à une procédure d’expulsion dès le rejet de leur demande d’asile en première instance, avant même un éventuel recours.
Liste controversée, inchangée depuis 2015.
Plusieurs associations s’étaient alors tournées vers la plus haute juridiction administrative, après que l’Ofpra a décidé le 5 novembre 2019 de ne pas modifier cette liste, inchangée depuis 2015. « La délibération du 5 novembre 2019 du conseil d’administration de l’Ofpra est annulée » et « les Républiques du Bénin, du Sénégal et du Ghana » doivent être retirées de cette liste, a tranché le Conseil d’État dans sa décision rendue vendredi.
Les ressortissants de ces trois pays ne pourront donc plus faire l’objet de procédures accélérées pour leurs demandes d’asile, autre conséquence du placement d’un pays sur la liste.
Concernant le Bénin, l’Ofpra avait déjà décidé en septembre 2020 de suspendre sa qualité de « pays d’origine sûr » pour douze mois, sans pour autant le retirer de cette liste. Pour le Sénégal et le Ghana, ce sont les risques liés à « l’orientation sexuelle » de leurs ressortissants qui ont motivé la décision. Le Conseil d’Etat a détaillé : « Compte tenu de l’existence de dispositions législatives pénalisant les relations homosexuelles au Sénégal et au Ghana et de la persistance de comportements, encouragés, favorisés ou simplement tolérés par les autorités de ces pays, conduisant à ce que des personnes puissent effectivement craindre d’y être exposées à [des] risques, l’Ofpra ne pouvait, sans commettre d’erreur d’appréciation, tenir ces États pour des pays d’origine sûrs dans l’examen des demandes présentées par leurs ressortissants. »
