Adopté en Conseil des ministres, lundi dernier, le projet de loi portant nouveau Code électoral, qui passe ce samedi en commission, est parti pour faire beaucoup de bruit dans le landerneau politique sénégalais. Au-delà de Karim Wade du Pds et Khalifa Sall de Taxawu Dakar, dont le sort est déjà scellé par l’article L31, devenu L.29 (d’autres articles antérieurs ont été supprimés ou fusionnés), d’autres Sénégalais (Ousmane Sonko, Abdoul Mbaye…) ne pourront pas s’inscrire sur les listes électorales, confie Seneweb.

L’article L29, qui est une simple transposition des dispositions du polémique article L31, stipule que : « Ne doivent pas être inscrits sur la liste électorale les individus condamnés pour crime ; ceux condamnés à une peine d’emprisonnement sans sursis ou à une peine d’emprisonnement avec sursis d’une durée supérieur à 1 mois, assortie ou non d’une amende pour l’un des délits suivants : vol, escroquerie, abus de confiance, trafic de stupéfiant, détournement et soustraction par les agents publics, corruption et trafic d’influence, contrefaçon et en général pour l’un des délits passibles d’une peine supérieure à cinq (5) ans d’emprisonnement ; ceux condamnés à plus de trois mois d’emprisonnement sans sursis ou à une peine d’emprisonnement d’une durée supérieure à six (6) mois avec sursis, pour un délit autre que ceux énumérés au deuxièmement ci-dessus sous réserve des dispositions de l’article L30 ; ceux qui sont en état de contumace ; les faillis non réhabilités dont la faillite a été déclarée soit par les tribunaux sénégalais, soit par un jugement rendu à l’étranger et exécutoire au Sénégal ; ceux contre qui l’interdiction du droit de voter a été prononcée par une juridiction pénale de droit commun (et) les incapables majeurs. »
Il convient ainsi de rappeler que le jeudi 4 juin 2020, la Cour suprême n’a fait que casser partiellement l’arrêt rendu en août 2019 par la Cour d’appel de Dakar sur cette affaire Abdoul Mbaye-Aminata Diack. En vertu de cette décision de l’institution juridictionnelle suprême, M. Mbaye ne va plus verser la rondelette somme de 100 millions de F Cfa à son ex-conjointe.
De plus, le juge a renvoyé les deux parties au procès devant la Cour d’appel de Ziguinchor pour ouvrir une nouvelle procédure sur les intérêts civils. Mais il convient de préciser que la peine de un an avec sursis qu’avait écopée Abdoul Mbaye n’a pas été cassée. C’est dire qu’il risque de subir le même sort que Khalifa Sall et Karim Wade, si toutefois la loi est votée à l’Assemblée nationale.
L’autre grosse ponte qui est en sursis, c’est bien Ousmane Sonko, dont l’affaire de mœurs portant sur un viol présumé (délit déjà criminalisé au Sénégal) l’opposant à une jeune masseuse du nom d’Adji Sarr n’est pas encore élucidée. Même si Ousmane Sonko est libre, après avoir été inculpé et placé sous contrôle judiciaire par le défunt Doyen des juges Samba Sall, son dossier reste pendant devant la justice.
Et, il faut le dire, une simple condamnation avec ou sans sursis peut le mettre sous le coup de cet article, étant donné que l’alinéa 1er de l’article susmentionné vise les « individus condamnés pour crime ».
